CCM: Nine pesticide-related patents expire in China in March 2016 05-10-2016

According to news from the State Intellectual Property Office of the P.R.C., nine patents which related to the pesticide industry expired in March 2016, paving the way for Chinese pesticide companies to capitalize.

According to news from the State Intellectual Property Office of the P.R.C., nine patents which related to the pesticide industry expired in March 2016, paving the way for Chinese pesticide companies to capitalize. Detailed expiry dates are just for reference only.

 

One of the nine expired patents, “Coccidioidomycosis Acid Derivatives” was applied for by Micro Company in 1998. It related to the preparation of new acaricides, parasite-killing drugs, insect-killing drugs and anthelmintic and also involved their application in preventing and controlling parasites in plants or plant products.

 

Insiders have pointed out that coccidioidomycosis acid derivatives can be applied as acaricides. However, its efficiency when applied in this way is unknown as it has not been tested in the market. Currently, spirodiclofen and abamectin are the two major acaricides products, and mainly target citrus. However, mites have become resistant to these two products over their many years of application. Thus, if coccidioidomycosis acid derivatives can prevent and control red mites, it might be a prospective substitute for spirodiclofen and abamectin.



 

Another three expired patents, including “New Ways to Prevent and Control Insects”, “Termite-killing Drugs and Their Application Methods” and “Methods to Lure, Prevent and Control Insects” were regarding the prevention and control of indoor insects such as cockroaches, termites and ants. These patents were related to the hygienic insecticides field.

 

The expired patent “Substituted Aminoquinazolinone (Thione) Derivative or Salts, Intermediate and Pest-controlling Agent and Using Methods” was used to develop a new pest-control agent and the expired patent “Agricultural and Horticultural Disease-controlling Agent and Controlling Methods” was applied in the agricultural and horticultural disease fields.

 

It is worth noting that of the nine patents which expired in March 2016, 3 were related to the production of glyphosate. In particular, “Preparation of Ammonium Glyphosate through Gas-solid Reaction System” and “Preparation of Ammonium Glyphosate Using Ammonium Hydroxide Solution in Liquid-solid Reaction System” were regarding the production of glyphosate technical while “Glyphosate Formulations that Contain Ether Amine Surfactant” concerned the production of glyphosate formulations.


However, insiders believe that the expiry of these three patents will have no practical meaning for domestic glyphosate manufacturers. That’s mainly because domestic production techniques for both glyphosate technical and formulations are able to compete with advanced international techniques, and also because domestic manufacturers actually hold many related patents themselves. That’s why China has output and exported huge volumes of glyphosate in recent years.

 

The detailed expiry dates are just for reference only. If manufacturers want to dig for market space, they should pay close attention to the actual state of these patents in order to avoid risks of Infringement. In addition, they should know that information about these expired patents is open to the public which means that there might be a lot of competitors and high market risks. Thus, pesticide manufacturers should seize opportunities based on their production equipment, development plans and core advantages.
